Terms of Services

These Terms govern your use of the Nextday Executive website and any enquiry you make through it. By using this site, you agree to them. Any specific engagement; a build, consulting, or a retainer,  is governed by a separate written agreement, which takes precedence over these Terms wherever they differ.

1. About us

2. Use of this website
You agree to use the site lawfully and not to misuse it, attempt to disrupt it, or copy its content without permission. The site is provided “as is,” and we may change, pause, or remove it at any time.

3. Enquiries and no guarantee of engagement
Submitting an enquiry doesn't create a client relationship or oblige us to work together. A working relationship begins only when both parties sign a written agreement (a proposal, statement of work, or contract).

4. Services and scope
The specifics of any build, consulting, or retainer; scope, deliverables, timelines, fees, and responsibilities are set out in your individual agreement. Where these Terms and that agreement conflict, the agreement controls. Any figures, packages, or timelines shown on this website are indicative and may change.

5. Fees and payment
Fees, payment schedules, and refund terms are defined in your agreement. Unless that agreement states otherwise, fees are non-refundable once work has begun.

6. Your responsibilities
Our work depends on timely access, information, and decisions from you, your team, and your tools. Delays in these may affect timelines and outcomes.

7. Results disclaimer
We bring real experience and a proven approach, but we don't guarantee specific business results, revenue, or outcomes. Results depend on factors outside our control; including how systems are adopted and used after delivery.

8. Intellectual property
Content on this website; text, branding, and materials, belongs to us unless stated otherwise and may not be reproduced without permission. Ownership of work created during an engagement is defined in your agreement.

9. Confidentiality
We treat your business information as confidential, and expect the same in return regarding our methods and materials. Confidentiality terms for an engagement are set out in your agreement.

10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential losses arising from your use of this site or its content. Liability relating to a paid engagement is addressed in your agreement.

11. Third-party tools
Our builds may rely on third-party platforms (for example, project and operations software). We're not responsible for those platforms' availability, changes, or pricing.

12. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles. If a dispute arises, we agree to first try to resolve it informally within 30 days of written notice. If we can't, any dispute will be subject to the exclusive jurisdiction of the courts located in the State of Wyoming.

13. Changes to these Terms
We may update these Terms from time to time; the current version always lives on this page.
